Welcome to the Creos X (“Creos”). Referral Club! We’re thrilled to have you in our vibrant tribe dedicated to sharing the gift of vitality, wellness and vibrant living. The Referral Club empowers you to earn financial rewards by introducing friends, family, colleagues, neighbors, acquaintances, and online communities to our WELLₓNESS Exchange.
Whether through a gift exchange to a vitality cycle or direct financial contributions to Creos, you can share value and reap rewards as others engage in the Creos experience. These Guidelines define the terms of engagement between you and Creos regarding your participation in the Referral Club.
Independent Contracting
You and Creos engage as independent contractors. This does not create a partnership, joint venture, employment, or agency relationship. You may not commit on behalf of Creos, and all actions must comply with the terms stated herein.
Referral Club Guidelines: General Participation Terms
➢ Eligibility: Participants must be at least 18 years old. Parental consent and partnership are required for minors.
➢ Single Account Policy: One account per person or legal entity. Sharing login details is prohibited and may lead to termination and loss of earnings.
➢ Human Users Only: Automated accounts (bots) are forbidden and will be terminated immediately.
➢ Accurate Information: Provide full legal name and valid email during registration.
➢ Account Security: You are responsible for safeguarding your account and password. Creos bears no liability for losses due to negligence.
➢ Content and Activity: You are accountable for all actions and content under your account.
➢ Lawful Use: The Referral Club may not be used for illegal purposes, including copyright infringement.
➢ Promoting Own Products: Earning commissions on personal product accounts requires written consent from Creos.
➢ Monthly Reset: Referral numbers reset to zero on the 1st of each month, excluding account balances below $180.
➢ Commission / Earning Payment: Disbursed solely on gift referrals using your Personal ID.
➢ Claiming Bonus Incentives: Club performers must electronically notify Creos upon achieving any exclusive Referral Club bonus incentive. Notification is required for verification and incentive issuance. Failure to provide notification will result in forfeiture of the incentive, and Creos assumes no obligation to issue unclaimed incentives.
➢ No Spamming: Spamming is strictly forbidden and will result in termination with forfeiture of earnings.
➢ Ethical Marketing: Creos may disqualify earnings obtained through fraudulent, illegal, or aggressive marketing methods.
Guidelines Updates: Creos retains the right to revise these Guidelines periodically. Continued participation implies consent to such changes.
Defining a Gift Referral ("GR")
GR encompasses a successful financial gift contribution to a Creos Vitality Cycle or illumineer fundraising (Exclusion detailed below).
Personal Affiliate Link ("Personal ID")
Once confirmed in the Creos Referral Club, you’ll receive a unique Personal ID for accurate tracking and reporting of referral earnings. This ID is essential for earning referral commissions and must be used with every referral.
Earning Commissions
Referral commissions are earned only on gifts given through your Personal ID. Creos is not responsible for missed earnings due to incorrect or non-use of your Personal ID.
Referral Earnings
Creos offers referral commission rates based on the exchange value, depending on the type of gift completed:
➢ Creos Vitality Cycles: Earn 20% on each successful GR contribution.
➢ illumineers (Capital Fundraisers): Earn 12% on new financial gifts to Creos' capital fund.
Earning Disclaimers:
✔︎ Earnings apply only toverified new financial gifts to Creos.
✔︎ All illumineer referrals are conducted with a certified Creos guide.
All verified commission is paid electronically. Creos does not issue paper checks.
Timing:
➢ Earnings are subject to a 60-day vesting period.
➢ Payments are drafted on the 29th of each month. If the 29th falls on a weekend or holiday, the next business day is used.
➢ Minimum Payout Threshold: Payouts occur at $180 or more, once fully vested.
Chargebacks: All GR contributions to Creos are final and non-refundable. If a chargeback, reversal, or refund occurs for any reason, any referral commission earned from that contribution will be reduced or removed from your account balance. Creos is not responsible for lost commissions due to chargebacks.
Monthly Referral Tracking Reset
➢ Monthly reset occurs on the 1st, resetting activities and bonus incentives, while preserving accrued earnings.
➢ Some incentives may be exempt from reset, detailed on our website.
Public Communication and Representation
➢ Press releases require prior written consent.
➢ Maintain accurate representation of your relationship with Creos. Avoid misrepresentation or implying broader affiliations.
Customer Definition
Anyone making a financial contribution through Creos is considered a Creos performer, subject to all rules and policies.
Your Responsibilities as a Referral Club Member
➢ Maintain your website and ensure technical functionality and content quality.
➢ Ensure compliance with agreements regarding Creos links and Personal IDs.
➢ Ensure all content is accurate, truthful, and legal.
➢ Clearly disclose data collection, usage, and storage practices.
➢ Track your referral earnings and incentives accurately to avoid forfeiture.
Following the Rules: Legal and Ethical Compliance
Adhere to all laws, regulations, and guidelines, including anti-spam regulations for marketing emails.
Agreement Duration, Termination, and Payout
➢ Termination: Either party may terminate with or without cause via written notice.
➢ Upon termination: Cease using Creos materials and links; payouts are based on accrued earnings.
Account Termination by Creos
Creos may suspend or terminate accounts for violations or conduct detrimental to Creos or its members.
Transparency and Fairness
Creos decisions are transparent and fair, but it reserves the right to refuse service to anyone.
Our Responsibility and Guarantees
Limitation of Liability: Creos is not liable for damages or total earnings beyond referral fees.
No Guarantees: No express or implied guarantees are provided regarding the Referral Club program or its offerings.
Your Acknowledgement and Independence
By participating, you agree to the terms outlined, recognizing Creos' right to adapt or compete.
Dispute Resolution Through Arbitration
Disputes will be resolved through confidential arbitration, with exceptions for intellectual property rights violations.
Governing Law and General Provisions
This agreement is governed by U.S. law, including provisions regarding waiver, assignment, and the agreement's full effect.
